Section Description

This course provides an overview of the law of contracts or, what might more appropriately be described as, the law of promises. We often make and break promises to each other, however the state will only enforce some of those promises. How do we tell the difference between a legally enforceable promise and an unenforceable promise? Once one makes a legally enforceable promise, how does a court go about: (1) deciding what are the terms of that contract, (2) interpreting what the terms mean, (3) determining whether a breach has occurred, and (4) fashioning an appropriate remedy? In this course, we will answer these and other questions relating to substantive contract law.
