Section Description
In this course, we will study the history, doctrine, and conceptual and popular understandings of the Fourteenth Amendment. We will examine significant constitutional developments leading to its adoption, its drafting history, and the different ways of interpreting it, with attention to the role of the political process, the Court, and social movements. Substantively, we will focus on birthright citizenship, the state action doctrine, equal protection, due process, incorporation, and disqualification.
