Columbia Law Faculty File Solomon Amendment Brief

The Supreme Court is currently considering a case brought by a group of law schools to challenge the Solomon Amendment, the law which allows the federal government to withhold funding from universities that prohibit military recruiting.  The schools hope to bar military recruiters because "don't ask, don't tell" violates the schools' anti-discrimination policies.

Fifty-six members of the Columbia Law School faculty have filed a brief which proposes a novel theory of the meaning of the Solomon Amendment that would resolve the case in favor of the universities and law schools.
