Regulation of the Digital Economy

***This course is for ELLM students only*** This course examines the regulation of the digital economy, with the emphasis on legal and policy developments in the United States and the European Union. Selective comparisons to other major economies, such as China, will be included. We will discuss data privacy, including the EU’s General Data Protection Regulation (GDPR); the role of antitrust law in reining in the power of the Big Tech; the regulation of online content, including hate speech and disinformation; the regulation of artificial intelligence and its impact on fundamental rights; and the regulation of platform workers, including whether these workers should be treated as employees. We will also examine regulatory conflicts between the US and the EU over data transfers and digital taxation, and analyze the drivers and implications of the ongoing tech war between the US and China. A student's grade will be based on a final examination and class participation.
