Section Description

This class proivdes an in-depth exploration of the financial issues that arise ancillary to divorce, focusing on the equitable distribution of property, post-divorce support and both pre-marital and post-marital agreements. The class will cover the financial isues in divorce from beginning to end, with a special focus on isues that may arise when an asset like a professional practices or bit coin have to be valued and distributed. Materials for the class include appellate court decisions, trial court decisions, expert valuation reports and in-force pre and post marital agreements. Students will also have the opportunity to examine current issues in matrmonial law through the questioning of a matrimonial judge in class, and through their own observations in a matrimonial court during the semester.

  • Understanding the financial aspects of matrimonial law as it is reflected in legislation and case law in various states. Statutory analysis, including the closs reading of statutes and comparative analysis of statutes.

  • Examination and assessment of the enormous discretion possessed by matrimonial judges and identification of what factors influence the exercise of such enormous discretion.
