Section Description

This course satisfies the J.D. Professional Responsibility requirement.

Not open to students who have taken another two- or three-credit Professional Responsibility course. Evaluation: Open-book take-home final examination or, with permission of instructor, paper; class participation.

The course focuses broadly on the ethical questions and challenges that typically arise in public interest practice (e.g. civil legal services, law reform, criminal defense, prosecution and government, and pro bono). The course explores the extent to which ethical principles should/do vary by practice context. Students examine the core ethical principles that are embodied in the Rules of Professional Conduct and consider several alternative conceptions of attorney role. Classes are interactive, using problems, ethics opinions, cases, reflective essays, and small group discussions. The course is intended for students who are interested in exploring ethical issues in the public interest context, regardless of where they intend to work after graduation.

This course also satisfies the LL.M. Professional Responsibility requirement for the California bar.

After consultation with and permission from the instructor, students may write a research paper on a topic related to the subject matter of the course, in lieu of taking the final examination.

  • Examining competing conceptions of professional role in individual and group discussions and reflecting about which roles are most appealing/valid
  • Developing the ability to anticipate, recognize, and resolve ethical issues
  • Developing an understanding of the ABA Rules of Professional Conduct, as well as selected provisions from codes of other jurisdictions; relevant ethical opinions; and other doctrinal materials relating to core ethical issues
  • Reflecting about how ethical issues arise in different practice settings, with a particular focus on the public interest context, broadly defined (including legal services, civil rights, government, pro bono)
  • Developing an understanding of the realities and pressures of public interest practice, issues of unmet legal needs, and attempts to address these
  • Reflecting about whether ethical rules should apply across-the-board or vary by practice context
