Section Description

This course focuses upon increasingly salient aspects of federal and state court litigation, most importantly, choice of law and personal jurisdiction at both the domestic and international (eg. EC) level. Arbitration, both as a substitute for judicial process and with respect to its enforcement will be considered. The course will also consider devices for handling multi-fora litigation, including preclusion, abstention, anti-suit injunctions, and claw-back statutes, once again at both the domestic and the international level. In addition to mastering a specific body of law including major concerns, the course aims to focus student attention on the judicial role in implementing legislative policy.

Enrollment is limited, and it is open only to law students and to LL.M.s with a common law background. Federal Courts is not a prerequisite for this course. Writing credit is not available and the final examination will be proctored.
