A 2020 ruling in favor of the rock band Led Zeppelin in a copyright infringement case may have pleased fans of the 1971 classic “Stairway to Heaven,” but the Ninth Circuit Court of Appeals erred in dismissing the inverse ratio rule, an important principle for proving copying that is consistent with other areas of law, explains Shyamkrishna Balganesh, Sol Goldman Professor of Law.
