Susan Scafidi, an Associate Professor of Law at Southern Methodist University Dedman School of Law, will give a talk on Iconoclasm in Intellectual and Cultural Property.
Description: Intellectual property and cultural property stand poised between the modern and the postmodern, between particularity and universality. The intellectual freedoms of the late 20th century that celebrated both the public domain and a new global society remain in tension with a reinvigorated sense of proprietary individualism and cultural nationalism in the early 21st. This paper attempts to place these oppositions in theoretical context, with particular attention to the role of destruction or iconoclasm in enabling creativity, and also to suggest a basis for considering the nature of imitation and secondary creation.
