Method of Evaluation: weekly journals; end of term simulation or paper
This simulation course is designed to give students the opportunity to study and practice a variety of lawyering skills in the context of representing nonprofit organizations.
The primary skills covered will be:
• interviewing and counseling transactional clients
• facilitation (dealing with conflict among members of an organization)
• negotiation (likely in the context of joint venture agreements)
• drafting contracts and governance policies
• presentation (e.g., to the board of an organization)
With respect to each skill, the general pattern will be to introduce theories and models for effective performance of the skill and to give students the opportunity to practice the skill via simulations both in class and out of class, to reflect on their performance and to receive feedback from the professor and from classmates. Many of the simulations will be designed to provide experience in dealing with ethical issues and with lawyering in multi-cultural contexts. The goal for each student will be to develop approaches to each skill that are both effective and comfortable – consistent with the student’s values and personal talents and preferences. Much of the work will be done in teams of two, so we will also be discussing strategies for effective collaboration.
