L8275 Employee Pension and Health Benefits Law

This seminar will examine the basics as well as current issues in the federal regulation of employee pension and health benefit plans. Employee rights, fiduciary standards, remedies, federal preemption, funding standards and retirement security, use of employer stock, antidiscrimination and qualified plan requirements, and legislative policy issues will be considered. Current areas of controversy to be considered may include: (1) federal preemption of state laws (including "pay or play" requirements), (2) fiduciary duties (including treatment of hidden fees in certain transactions), (3) retirees' medical benefits (including cutbacks of retiree medical benefits); (4) "distress" (mainly bankruptcy) situations, including treatment of pension and medical plans in insolvency situations; and (5) certain ethical considerations in representing a fiduciary.
