This is a survey of the United States Bankruptcy Code. Although the course will emphasize business bankruptcy and corporate reorganization, we will review major feartures of consumer bankruptcy law. We will study the principal provisions of the Bankruptcy Code, such as the automatic stay, claim valuation, various avoiding powers, the use and sale of property, and the reorganization process. We will explore how bankruptcy provisions can be used to alter non-bankruptcy outcomes and consider whether they serve optimal bankruptcy policy.
