This survey course focuses on selected legal issues that arise in public and private elementary and secondary schools. Topics include compulsory education; regulation of public and private schools; church-state issues, including voucher and choice plans; free speech rights of students and teachers; the school's authority to make and enforce rules governing student and staff conduct, on and off school grounds; the duty to protect the safety of students and others; child abuse; search and seizure; and due process.
This course is also offered through Teachers College in the fall semester as ORLA 4086, and the class will include 30-40 education, journalism, and social-work students along with CLS students. The course is different from many CLS courses in that it explores not just the law but also the non-legal policy issues (educational, political, ethical, administrative, financial) that legal conflicts often raise. The course also examines relevant social-science research. This course is therefore best suited to students who wish to take an iinterdisciplinary and interprofessional approach to the subject matter..
