This course will examine the history and jurisprudence of the Fourteenth Amendment's equal protection clause. It will examine the legislative history of the Fourteenth Amendment , It will then trace the Reconstruction era's 14th Amendment"s tenuous journey toward Plessy v. Ferguson and the Twentieth Century effort to overturn the "separate but equal" regime that culminated with Brown v. Board of Education. It will then consider post-Brown equal protection jurisprudence in school desegregation and other cases, including contempory affirmative action challenges. The course will also examine the application of equal protection principles to gender and other claims.
