Property is a core social institution; its legal definition poses fundamental questions about efficiency, fairness, the distribution of wealth, and the tension between public and private rights. What can be owned? What does it mean to own something? How much can government regulate or take away our stuff? The American law of property developed answers to these questions mainly in the struggle over land. Today, these same questions arise in conflicts over ownership of artistic and digital creations, body parts, cyberspace, and one's earning capacity. We will examine property law and theory through the prism of these old and new resource conflicts.
