Cambridge University Press v. Patton: Fair Use and Course Websites

Cambridge University Press, currently before the Eleventh Circuit for the second time, presents the question of when universities are required to license all or part of copyrighted works they post to course websites, and when they can rely on fair use.  Defendant Georgia State’s reliance on fair use significantly increased as it shifted from using copyrighted works in hard copy course packs to posting them to online course websites, and the final result in this hotly contested suit will affect many educational institutions and publishers.
