SUMMARY:Law and Economics Workshop
DESCRIPTION:The Center for Law and Economic Studies' Guest speaker for today's Law and Economics Workshop will be George L. Priest, Edward J. Phelps Professor of Law and Economics, Yale Law School, presentation "TBD" All are welcome\nAbstract\: The success of the Standard Oil monopoly is not well understood. Standard Oil first developed a monopoly over the refining of crude oil, though later extended its control to gathering pipelines, later still to trunk pipelines (from the western Oil Regions to East Coast ports) and, even later, expanded operations to include oil production (drilling) and retail sales at the time the Supreme Court ordered its dissolution over 100 years ago, in 1911. \nThough there are several journalistic exposés of Standard Oil—including Henry Demarest Lloyd and Ida Tarbell, as well as business histories—none are fully explanatory. The currently dominant theory of Standard Oil's success is by Elizabeth Granitz and Benjamin Klein who assert that Standard Oil was chosen by oil shippers, the railroads, to police a railroad cartel. According to Granitz and Klein, the railroads split with Standard Oil the profits from cartelization of the crude and refined oil industry. \nThis Article challenges that explanation, claiming that there were attempts made to cartelize at all levels of the oil industry—producers, gathering pipelines, refiners, and railroads. There are good economic reasons that explain why Standard Oil, a refiner at the remote western location of Cleveland, acquired most of the pipelines and secured a monopoly against the producers and the railroads.

SUMMARY:Investing in Growth\: The Mining Industry's Approach to Community Development
DESCRIPTION:The Vale Columbia Center on Sustainable International Investment (VCC) and the Commodities Club at Columbia Business School will be hosting a talk by Jon Samuel, Head of Social Performance for Anglo American, on "Investing in growth\: the mining industry's approach to community development," at Columbia Law School, Jerome Greene Hall, Room 940.\nMining environments can be complex. Many major mining projects, especially in sub-Saharan Africa and South America, take place in impoverished regions with pre-existing development challenges, under-developed economies and vulnerable ecosystems. However, these major mines, if run responsibly, have the technical and financial capital not only to raise communities out of extreme poverty by improving traditional development indicators such as health, education, agricultural yield, nutrition, infrastructure, and gender equality, but to help ignite a viable market economy through a combination of employment, local purchasing, infrastructure investments, taxes and payments, training and extension programs.\nJon Samuel will discuss how the mining industry has approached the challenge of community development, including whether, why and how mining companies are responsible for and/or can contribute to community development in their areas of operation. In that context, he will also explain how Anglo American approaches this issue by providing an overview of the company's small business development programmes, local procurement initiatives and Socio- Economic Assessment Toolbox. His talk will be followed by a discussion with participants.\nLight snacks will be served.

SUMMARY:Fellowships at Auschwitz for the Study of Professional Ethics Info Session
DESCRIPTION:These Fellowships designed to address contemporary ethical issues facing lawyers involve an all expenses-paid program to Berlin, Oświęcim (Auschwitz), and Nuremberg to examine such topics as\: the challenge of ambition in professional development, ethics and government lawyering, dilemmas in day-to-day practice, and ethical approaches to truth and disclosure. Join fellowship staff, faculty and a past fellowship participant for an informational session on the fellowships.Lunch will be served. Hosted by Social Justice Initiatives.______________________________The Fellowships at Auschwitz for the Study of Professional Ethics (FASPE), is inviting applications for its Law program, one component of a larger program designed to address contemporary ethical issues facing professionals in various fields. FASPE Law uses the conduct of lawyers and judges in Nazi Germany and the Holocaust as a launching point for an intensive course of study on legal ethics. FASPE is predicated upon the power of place, and in particular the first-hand experience of visiting Auschwitz and traveling through Germany and Poland where Fellows study the past and consider how to apply the lessons of history as they confront the ethical challenges of today. Last year the program was co-directed by Professor Brett Dignam and included Morenike Fajana (class of 2014) as a Fellow. In 2013 FASPE will take a group of 10-15 law students on an all expenses-paid program to Berlin, Oświęcim (Auschwitz), and Nuremberg where they will examine such topics as\: the challenge of ambition in professional development, ethics and government lawyering, dilemmas in day-to-day practice, and ethical approaches to truth and disclosure. FASPE believes in the broad applicability of ethics training and is looking for students with a wide range of legal interests, ranging from real estate and corporate law to human rights advocacy and public interest law. The program dates in 2013 will run from May 26 to June 6. The fellowships will cover all program costs, including international and European travel, lodging, and food.

SUMMARY:The Failing Mafia State
DESCRIPTION:Please join the Harriman Institute and Columbia Law's Center on Global Legal Transformation for a talk by William Browder (Founder and CEO of Hermitage Capital Management).Registration is required.Respondents\:Ian Hague (Co-Founder, Firebird Management)Kimberly Marten (Acting Director, Harriman Institute and Professor of Political Science, Barnard College)William Browder is the Founder and CEO of Hermitage Capital Management. He was the largest foreign investor in Russia and a Putin supporter until November 2005, when he was suddenly expelled from the country and declared a "threat to national security" by the Russian government. The reasons for these actions remain unclear, but were probably retaliation for Browder's accusations about corruption in large state-controlled firms where he was a minority shareholder. His holdings and employees in Russia came under increasing attack. In 2008, his lawyer, Sergei Magnitsky, announced his discovery that $230 million in state taxes paid by Hermitage in 2006 had been stolen in a bogus tax refund scheme by a group of Russian officials working with organized criminals. Magnitsky was arrested and imprisoned without trial, accused of perpetrating the fraud himself on behalf of his client, and pressured to confess. Denied medical treatment for his growing health problems despite numerous requests, Magnitsky died in prison after a severe beating in November 2009, at the age of 37. Since then Browder has led a tireless legal and legislative campaign in the United States and Europe to punish the individuals responsible for Magnitsky's arrest and death. Hermitage today is based in London, where it continues to invest in emerging markets. This event is part of our 2012-13 "Corruption and Patronage" core project. The project examines these issues both within Eurasian societies and comparatively, and asks the provocative question\: do corruption and patron/client favoritism always impede progress, or are they a way to get things done in societies that lack well institutionalized legal systems? The program will begin with a reception at 5\:30 in Jerome Greene Annex, followed by the talk in 103 Jerome Greene Hall.
