DESCRIPTION:The Federalist Society invites you to "Rules, Rulemaking, and Lessons of Life\:  The Story of 'Shall,'" a talk by the Hon. Lee H. Rosenthal, U.S. District Court for the Southern District of Texas. Since 1938, courts, lawyers, and litigants have struggled over when it is constitutional, fair, and sensible to have a court decide a case and stop it from proceeding to a jury trial.  The most recent efforts to clarify the rule resulted in a robust and --- yes --- dramatic debate about the proper roles of a judge and jury and the impact of court rules on different kinds of litigants and claims, such as civil rights cases involving thinly financed plaintiffs.Judge Rosenthal was appointed to the district court in 1992. She has served as the chair of the Judicial Conference Advisory Committee on the Federal Rules of Civil Procedure and she now  chairs the Judicial Conference Committee on Rules of Practice and Procedure, making her eminently qualified to talk on this topic. DESCRIPTION:The aim of the Modern Money and Public Purpose seminar series is to dispel commonly held economic myths about money, macroeconomics and government financing, and to outline an alternative progressive paradigm grounded in the legal and institutional realities of the global monetary system. In addition of the obvious relevance of macroeconomics to the ongoing global economic crisis, the series aims to address the fundamental economic problem of full employment in the context of economic rights and long-term sustainable development. The speakers come from a diverse set of fields (including History, Law, Finance, Economics, Social Work, Criminology and Systems Theory) but share an understanding of what money is, how it works, and how flaws in the legal structure of the monetary system are contribute to systemic and day-to-day economic problems including unemployment, excessive student debt and stagnating real wages.This seminar explores the intersection between the real and monetary (or nominal) economy. It addresses popular misconceptions surrounding the "sustainability" of government deficits, national debt and the U.S. trade deficit. SUMMARY:The Transfer of Persons at Risk of Torture in European Human Rights Law\: The Relative Protection of an Absolute Prohibition
DESCRIPTION:Please join HRI for a lunch time talk with Andrea Saccucci. Elaborating on the principle of non-refoulement as it currently stands \nin international human rights law, Andrea will discuss states&#8217; \nobligations relating to the transfer of persons at risk of torture or \nill-treatment under the most recent case-law of the European Court of \nHuman Rights. \nNotably, Andrea will try to highlight the existing gaps and \ninconsistencies in the application of the absolute prohibition of \nnon-refoulement and the margin of relativity inherent to the control \nover the risk of ill-treatment in the receiving state. \nAndrea is a Professor of International Law at the Second University of Naples; he is also Adjunct Professor of Migration Law at the LUMSA of Rome and currently holds a course of International Protection of Human Rights at the Master of International Relations of the Catholic University of Milan. Andrea was a Visiting Scholar at the Law School of the Columbia University of New York in 2006, and ever since he has been cooperating with the Human Rights Clinic and the Human Rights Institute. He is one of the leading counsel in Italy for litigating individual and collective cases before the European Court of Human Rights and other international and national human rights bodies. He successfully litigated before the Strasbourg Court the Hirsi case which led to the adoption of a landmark judgment outlawing the practice of the pushback of sea migrants to Libya, and he was recently awarded the PILnet&#8217;s 2012 European Pro Bono Award for exemplary partnership in the public interest in relation to the successful litigation before the European Court of Human Rights on behalf of the &#8220;erased&#8221; of Slovenia in the Kuric case.

SUMMARY:Allegations of Corruption In International Arbitration\: What Standard of Proof and What Role for Public Policy?
DESCRIPTION:Allegations or hints of corruption arise in commercial and treaty-based arbitrations, confronting attorneys and arbitrators with a number of important legal and policy issues and questions about which there appears to be relatively little guidance or consensus on approach. These questions include\: \nWhat is the burden and standard of proof necessary to establish that there has been corruption?\nWhat are the tools available to parties and tribunals to deal with evidentiary issues relating to corruption? \nIs there a public policy role or requirement for arbitrators and/or counsel to raise corruption issues outside the scope of the arbitration and, if so, at what point do allegations become concrete enough to trigger this role? \nWhat are the implications for parties&#39; claims and defenses of successfully proving corruption? Are those implications different in the investment treaty context than they are in the commercial context? \nTo address these issues, the Center for International Commercial and Investment Arbitration (CICIA) and the Vale Columbia Center on Sustainable International Investment (VCC) are hosting a debate with Sophie Nappert and Mark Beckett. The debate will be moderated by Rahim Moloo, and will take place in the Case Lounge at Columbia Law School, 7th floor, on November 15, 2012, at 5\:30 pm. Registration is not required for this event. \nThe views expressed during the debate will not reflect the personal opinions of the participants or their respective institutions or clients.
