The growing problem of online counterfeiting raises new questions regarding the enforcement of intellectual property (IP) rights, especially regarding the exercise of jurisdiction in private international law. The speaker examines the different approaches that courts in the European Union and the United States take toward the question, whether a court may assert jurisdiction when an infringing content is accessible online in that country.

The speaker will trace the role of punishment in shaping material and procedural Criminal Law.
