DESCRIPTION:When the Supreme Court last spoke on affirmative action in the Grutter and Gratz cases they anticipated the sunsetting of these programs in twenty-five years. Sixteen years early, the Court is now hearing oral arguments in the latest attack on affirmative action programs in Fisher v. Univ. of Texas. In the backdrop of the Court's eventual decision in Fisher other race conscious and disparate impact challenges to school admissions programs abound--including one right here in NYC centering around Latino and Black students challenging the validity of NYC's Specialized High School Admissions Test (SHSAT) as the sole factor for admission to specialized high schools in the City.Please join the Center for Intersectionality and Social Policy Studies as well as LaLSA, NALSA, BALSA, APALSA, EWOC, ELPS, and the Columbia Journal of Race and Law for a panel discussion of Fisher v. Richard A. Posner, U.S. Court of Appeals for the Seventh Circuit. Judge Posner will compare textualism, originalism, and canons of construction, on the one hand, and "living" interpretive approaches, on the other hand, to statutory and constitutional texts. After demolishing both ends of the spectrum, he will propose his own middle ground, stressing analytic  simplicity and common-sense pragmatism. DESCRIPTION:Hector Villagra '94, Executive Director of the ACLU of Southern California and SJI's Fall 2012 Visitor from Public Interest Practice, will discuss how, despite procedural and other substantial hurdles, public interest litigation still can and does succeed.  Young lawyers can contribute as public interest attorneys or pro bono counsel. Please join Mr. Villagra for a lunchtime discussion of these and other issues related to his work at the ACLU. DESCRIPTION:The ABA Forum on the Construction Industry would like to invite interested law students or alumni to attend the Forum&#8217;s Fall Meeting in Boston, &#8220;Construction Counseling, Pulling Together For a Winning Strategy.&#8221;\n \nThis is one of three national programs put on by the Forum per year and will attract 300 to 400 construction attorneys from around the country.  The 2012 Boston program has been designed from the outset to deal with issues of interest to in house and outside counsel and will provide any law student  an excellent glimpse of &#8220;Real World&#8221; industry CLE at a very high level.  The program will feature segments on such cutting edge topics as &#8220;Saying No to the CEO,&#8221; which will take on having those difficult conversations between attorney and client, and how to turn them into relationship-building experiences.  Other sessions deal with topics such as hiring and firing outside counsel, working across state lines, insurance and surety products for innovative contract methods, avoiding false claims exposure, cross-border disputes, and a look at where construction dollars are going now from two of the industry&#8217;s leading economists.
