SUMMARY:Factory Life after Foxconn\: Investigating Labor Conditions and Workers' Right in China.
DESCRIPTION:Please join the Society for Chinese Law in welcoming Mr. Li Qiang, Founder and Executive Director of China Labor Watch (CLW).  CLW has conducted independent investigations into worker conditions in more than 200 factories supplying transnational companies including Disney, Apple (Foxconn), Samsung, and Mattel. Since the high-profile suicides of Foxconn workers in 2010, labor conditions in China have received increased scrutiny worldwide. Mr. Li will discuss the aftermath and impact of Foxconn on workers' rights as well as subsequent CLW investigations into suppliers of other large transnational corporations. Mr. Li will also share his insights on working on labor condition investigations as well as how CLW works with local organizations to provide direct assistance to workers. A Q&amp;A moderated by Professor Barenberg will follow the talk.Prior to founding CLW in 2000, Mr. Li played a leading role in organizing networks of labor activists, researching factories, and conducting worker education and legal assistance programs.  He has contributed opinion pieces to China Youth Daily, South China Morning Post, Nanfang Chuang and The Seattle Post-Intelligencer and has been referenced in The New York Times, Washington Post, The Wall Street Journal, BBC, CNN and others. In 2004, Mr. Li taught as a visiting scholar at The Center for the Study of Human Rights at Columbia University.The talk will be in Chinese with English translation. DESCRIPTION:HRI invites you to a lunch time discussion with Francesco Francioni. International Law on the protection of cultural heritage in time of war has evolved considerably in the past 15 years. The 1954 Hague Convention gained an additional (Second) Protocol in 1999 as well as a much awaited ratification by the United States in 2009; the General conference of UNESCO adopted by unanimous vote a Declaration prohibiting the intentional destruction of cultural heritage; and offences against cultural heritage are now part of the catalogue of international crimes in the Statutes of international courts and tribunals. Yet, this intense normative action has not prevented the recurrence or continuation of barbarous acts of destruction and pillage of cultural property of great importance for humanity, as the bombing of the World Heritage medieval market of Aleppo, and the extensive destruction of Muslim monuments and ancient manuscripts in Mali.\n\nThis presentation proposes a two pronged approach to improving the enforcement of international cultural heritage standards\: 1) enhancing the law of individual criminal liability for serious offences against cultural heritage along the model of the International Criminal tribunal for Yugoslavia, and 2) expanding the &#8216;Responsibility to Protect&#8217; doctrine,as enunciated in 2005 by the UN, so as to cover situations of egregious and widespread  destruction of cultural property, especially when it is part of a discriminatory and persecutory design.\n

Bustin is a senior counsel at Cleary Gottlieb Steen &amp; Hamilton LLP (New York and Brussels). From 2008-2010 he was also a Visiting Lecturer at the Woodrow Wilson School of Public and International Affairs at Princeton University, where he taught graduate and undergraduate seminars on relations between the European Union and Russia, with a focus on European energy policy.   Since 2007 he has been associated with Princeton's Program in Law and Public Affairs. From 1982 until 2007, Mr. Bustin was a partner of Cleary Gottlieb based primarily in Brussels. From 1993 until 2007 he was one of the principal outside legal advisers to the Russian Ministry of Finance in connection with the restructuring and repayment of Soviet-era sovereign debt in the context of the Paris Club.  Mr. Bustin also acted for other sovereign and corporate clients in Europe and the United States and has published numerous articles on legal subjects relating to the EU and to Russia.  He is a special adviser on European law to the American Bar Association&#8217;s Section on International Law and Practice, from which he received a special achievement award in 2004. Mr. Bustin holds degrees from Princeton University (1970, summa cum laude, Phi Beta Kappa) and Harvard Law School (1973, magna cum laude)

DESCRIPTION:In July 2010, Goldman Sachs agreed to a $550 million settlement of the SEC&#8217;s claims that it violated the securities laws in connection with a collateralized debt obligation (CDO) transaction known as ABACUS. During this discussion, Professor Jackson, of Columbia Law School, and Professor Morrison, of the Said Business School at the University of Oxford, will analyze the ABACUS transaction, and other deals like it, in the context of recent changes within the investment banking market.Non-pizza lunch will be served. DESCRIPTION:Mr. Li will begin his talk from the perspective of Hong Kong&#8217;s markets, but will touch upon the trend in China&#8217;s opening up as well.Charles Li '91, Chief Executive of Hong Kong Exchanges and Clearing (HKEx), will speak on his experiences as the head of one of Asia's most important exchanges. Mr. Li worked as an offshore oil worker in the north China sea prior to college, and a newspaper editor-reporter for China Daily from 1984-1986. He obtained a B.A. degree from Xiamen University of China in 1984, an M.A. degree from the University of Alabama in 1988 and a J.D. degree from Columbia University School of Law in New York in 1991.
